Yacht Charter: Terms & Conditions:

Al Wasmy II is operated by Mazaya Oman Marine Tourism LLC.

Charter Passenger Personal Identification:
All charter passengers must provide personal identification of either their Passport or Copies of Passport or Oman Driving Licence as requested by Oman Coastguard Regulations prior to departure. Anyone without personal identification will not be permitted on board. Any delay caused by failure to provide the proper identification will be at the charterer's expense.

Overnight Charters:
Please note that for overnight trips the Check-In time is 0900hrs and the Check-Out time is 1200hrs.

Charter Inclusions:
These basic items are included within the yacht charter fee:
Selected Yacht, Captain and at least 1 Crew Member, fuel, water, ice, soft drinks, fishing rods (for Fishing Charters), and Inflatable recreational toys.

Passenger Parameters:
Passenger numbers must be confirmed at the time of the booking or 24 hours prior to departure.

Captain's Authority:
The Captain has total authority over seamanship and the safe navigation of the yacht, its crew and passengers. The Captain has total authority over the safe use of all equipment onboard and may prohibit activities deemed to be unsafe.

Responsibility for Children:
Any children onboard are the sole responsibility of their parents or guardians. The crew will not be responsible for children and are not child-minders.

Shoes:
Flat non-marking soled deck shoes or trainers are permitted onboard. Shoes with heals are not permitted to be worn onboard. Comfortable clothing and suntan protection are recommended.

Availability:
Bookings are accepted subject to availability of the charter yacht. If a booking has to be cancelled due to yacht unavailability, no liability will be accepted. Any monies already paid will be refunded in full.

Payments:
A deposit of 50% of the charter cost is required to confirm a booking. This should be paid within 7 days of making the reservation. The balance must be paid 1 week prior to the charter date. If the balance is not paid by the due date we reserve the right to cancel the booking and forfeit the deposit. If you book less than 1 week prior to departure date, the full amount is payable on booking.
Payments for your yacht charter are accepted by bank transfer. Personal cheques and bank drafts are acceptable but a booking will not be considered to be finalized until cleared funds have been received.
We reserve the right to amend our prices at any time prior to booking. However, once a Confirmation Invoice has been issued the price of the charter will not be increased unless we are required by law to charge a Government tax or levy introduced or changed after your booking is made. This does not apply to Invoice errors or omissions.
Prices are inclusive of fuel unless stated otherwise. We reserve the right to correct any pricing errors or omissions that may occur. We recommend that you book and pay in full as soon as possible to ensure the availability and pricing of any charter shown. Please note the payment due dates and ensure payments reach us in plenty of time. Your booking will automatically lapse if payment is not received.

Cancellation of Charter by Mazaya Oman Marine Tourism:
Mazaya Oman Marine Tourism reserve the right to cancel or postpone a charter due to poor weather conditions, mechanical failure with, Coastguard restrictions or Sultanate of Oman Law enforcement decrees. In this instance, the charter will be rearranged. If this is not possible, any charter fees already paid will be returned in full.

Cancellation by Charter Clients:
All cancellation requests received 7 days prior to the trip date will get a full refund of the booking deposit, less 20% handling fee.
Cancellations received up to 3 days prior to the trip will get a 50% refund of the total package cost. Payment made online or using credit card refund will be processed via bank transfer and will attract 3% + OMR 15.000 as bank charges. Cash payment will be refunded as full.
There is no refund on any cancellation done 2 days prior to the trip or for customers that do not show up the date of the trip.

Recreation Liability Indemnity:
No liability is accepted for any personal injury during any recreational activity including swimming, fishing, parasailing or any other water sports.

Anti-Social Behaviour:
No anti-social behaviour will be accepted and will be reported to the Police. Anti-Social behaviour will result in the early termination of the charter.

General Liability Indemnity:
No liability or responsibility is accepted for any loss or additional expenses incurred as a result of accident, injury, sickness or death.

Observance of al Sultanate of Oman’s Law and Practices
The following must be observed under Oman Law:
1. Number of passengers must not exceed those stated on charter registration
2. All persons under 21yrs must be supervised by a mature adult
3. All foodstuffs brought onboard by passengers must be that which is Sultanate of Oman approved
4. All fishing must be conducted under Sultanate of Oman regulations
6. No animals or pets may be brought onboard
7. Captain and crew member contingent as required for charters under the Sultanate of Oman law.
